Terms of sale

These General Terms and Conditions of Sale (hereinafter the “T&Cs”) govern all sales of products carried out by LABORATOIRES AQUA MEDICA SAS, operating under the brand “Eau Lala”, through the website www.eau-lala.com.

Article 1 — Purpose

The purpose of these T&Cs is to define the rights and obligations of the parties in connection with the online sale of products offered by LABORATOIRES AQUA MEDICA SAS on the website www.eau-lala.com.
The Customer acknowledges having read these T&Cs prior to placing an order and accepts them without reservation.

Article 2 — Products

The products offered for sale are dietary supplements in the form of effervescent microbeads, marketed under the brand “Eau Lala”, as well as accessories (insulated bottles). The products are described and presented on the website with the greatest possible accuracy.

In accordance with applicable regulations, dietary supplements are not medicines and cannot replace a varied and balanced diet or a healthy lifestyle. The health claims mentioned on the website comply with Regulation (EC) No. 1924/2006 on nutrition and health claims.

Photographs illustrating the products are provided for informational purposes only and are not contractually binding. Slight differences between the photographs and the delivered product shall not engage the liability of the seller.

Article 3 — Prices

Product prices are indicated in euros (€), all taxes included (VAT included), excluding shipping costs. Shipping fees are displayed before the final validation of the order.

LABORATOIRES AQUA MEDICA SAS reserves the right to modify its prices at any time. Products will be invoiced on the basis of the prices in effect at the time the order is confirmed.

Article 4 — Order

The ordering process includes the following steps:

The Customer selects the products and adds them to the shopping cart.
The Customer reviews the contents of the cart and the total amount of the order.
The Customer enters delivery and billing information.
The Customer selects the delivery method.
The Customer accepts these T&Cs by checking the designated box.
The Customer proceeds with payment.
The Customer receives an order confirmation email.

The sale is considered final once the order confirmation email has been sent to the Customer, which constitutes proof of the sales contract.

Article 5 — Payment

Payment is made securely online by credit card (Visa, Mastercard, American Express) through the payment services available on the website (Shopify Payments, PayPal, Apple Pay, Google Pay, or any other payment method made available).

The total amount of the order is charged at the time of payment confirmation. The order will only be processed once payment has been successfully received.

Article 6 — Delivery

Orders are delivered to the address provided by the Customer during the ordering process. Delivery times are indicative and may vary depending on the carrier and the destination.

For mainland France, delivery generally takes 2 to 5 business days from the date of shipment. Deliveries to Europe and other international destinations may take longer.

In the event of a delivery delay exceeding 30 days beyond the expected delivery date, the Customer may cancel the order and obtain a full refund in accordance with Article L.216-2 of the French Consumer Code.

Any delivery issue (damaged parcel, missing item) must be reported within 48 hours of receipt by email at: hello@eau-lala.com.

Article 7 — Right of Withdrawal

In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has a period of fourteen (14) calendar days from receipt of the product to exercise the right of withdrawal, without having to justify any reason or pay penalties.

To exercise this right, the Customer must notify their decision by email at hello@eau-lala.com or by mail sent to the company’s registered office, accompanied by the withdrawal form or any clear statement expressing the decision to withdraw.

The Customer must return the product(s) within fourteen (14) days following notification of withdrawal. Return shipping costs are borne by the Customer.

Products must be returned in their original packaging, complete, unopened, and in perfect condition. Any product that has been opened, used, or damaged will not be refunded.

LABORATOIRES AQUA MEDICA SAS will refund all amounts paid, including standard delivery costs, within a maximum period of fourteen (14) days from receipt of the returned products or proof of their shipment.

The right of withdrawal cannot be exercised for products whose packaging has been opened by the Customer. Dietary supplements fall under the exceptions provided in Article L.221-28 of the French Consumer Code for sealed goods that cannot be returned for health or hygiene reasons once unsealed after delivery.

Article 8 — Legal Guarantees

Products sold on the website benefit from the following legal guarantees:

Legal guarantee of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code)
The consumer has a period of two (2) years from delivery of the product to invoke the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only needs to demonstrate the existence of the defect and not the date on which it appeared.

Legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code)
The consumer may choose to invoke the warranty against hidden defects in the product. In this case, the consumer may choose between cancellation of the sale or a reduction in the purchase price in accordance with Article 1644 of the French Civil Code.

Article 9 — Liability

The products marketed by LABORATOIRES AQUA MEDICA SAS are plant-based dietary supplements. They are not medicines and cannot under any circumstances replace medical treatment.

It is recommended to consult a healthcare professional before consumption, particularly in the event of pregnancy, breastfeeding, ongoing medical treatment, or specific health conditions.

LABORATOIRES AQUA MEDICA SAS cannot be held liable for improper use of the products or failure to follow the precautions for use mentioned on product pages or packaging.

Customer service will respond as soon as possible.

Article 11 — Dispute Mediation

In the event of a dispute relating to these T&Cs, the Customer may, after attempting to resolve the matter directly with the seller, use a consumer mediation service free of charge.

Article 12 — Applicable Law and Jurisdiction

These T&Cs are governed by French law.

In the event of a dispute not resolved through mediation, the competent courts within the jurisdiction of the company’s registered office shall have exclusive jurisdiction, unless mandatory legal provisions grant jurisdiction to another court for the benefit of the consumer.

Article 13 — Personal Data

Personal data collected when placing an order is necessary for processing the order. Such data is processed in accordance with the GDPR and the French Data Protection Act.

Article 14 — Partial Invalidity

If any provision of these T&Cs is declared invalid or unenforceable by a court decision, the remaining provisions shall remain in full force and effect.
